Issue: TRAX on the ROW
 
In October of 2006 the Draper City Council endorsed by resolution the UTA's Alternatives Study and their recommendation of the UTA owned right-of-way (ROW) as the Locally Preferred Alternative for running TRAX through Draper.
 
A citizen's group, Citizen's for Responsible Transportation (CRT), was formed to fight that decision and to support "the further study and consideration of the UTA proposed State Street alignment", "public transportation that brings value to Draper & the surrounding communities", and a "TRAX alignment that does not negatively impact the lives of Draper citizens". That group pursued a referendum on the City Council's endorsement of the Locally Preferred Alternative and the city determined that their effort fell short of the required number of signatures. However, CRT believes that over 100 signatures were discounted unfairly and that their efforts were, in fact, successful. They have since pursued legal action.
 
In April 2007, Judge Leon Dever of the 3rd District Court ruled that the number of signatures obtained by CRT in their referendum efforts were irrelevant because the city's nonbinding resolution was not a law and only a law can be challenged by referendum. CRT has appealed that decision and the Utah Supreme Court has agreed to hear that appeal.
